Company Policy: DELIVERY
Definitions:
The Seller – PA Opperman t/a Katima Brickmaking
The Customer – Person purchasing goods/services or any representative of the Customer
Delivery Vehicles – Any Vehicle or Machinery of the Seller with special reference to vehicle used to deliver the goods
Goods – Any Sand, Bricks, Aggregates and/or services purchased by the Customer
1. The Seller’s responsibility ceases on delivery to the Customer’s given address or to the Customers own transport.
2. Where the Seller undertakes delivery with his own vehicles, it shall be delivered at the public kerbing at the entrance to the Customer’s site. The Seller’s delivery vehicles enter and remain on the Customer’s site at the Customer’s sole risk. The Customer hereby indemnifies the Seller against any damages or claims that may arise due to the use or delivery of the goods including negligence of the Seller’s Employees.
3. Any time or date for delivery is given in good faith. The Customer shall not be entitled to cancel or repudiate the Sale, or claim charges due to late delivery and shall accept delivery when affected.
4. No refunds or exchanges will be entertained. Therefore, the Customer is requested to make sure that the purchased goods are correct.
5. Delivery Address: It is the sole responsibility of the Customer to ensure the Seller has the correct Delivery Address, contact person and contact number. No claims will be entertained where incorrect Delivery Address were given.
6. Drivers: All the drivers and employees of the Seller have fixed instructions to only deliver at public kerbing as per paragraph 2. Should the Customer require the Seller to deliver inside a yard or on a specific path, it will be at the sole decision of the driver to enter or refuse to enter any area, path, road or yard of the Customer.
7. The Seller undertakes to only deliver along Main Roads. Should Secondary Roads be used, it is up to the Driver’s discretion to decide whether the road is accessible. Delivery will take place at the point where the Driver decides the road becomes unsuitable for delivery. Any goods returned due to inaccessible roads, will be for the Customer’s account.
8. It is the responsibility of the Customer to ensure the totals on the delivery note correspond with the total delivered and by signing the delivery note, the Customer agrees that the correct totals were received.
9. Prices are subject to change without prior notice.
10. Distance: For any delivery 10 km or more from Katima Mulilo it is the responsibility of the Customer to ensure the Seller has the accurate distance. In the situation where the Customer neglected to give the correct information, the Seller may refuse to deliver the goods past the paid kilometres or delay delivery. The Customer will be liable to pay any excess fees in this regard.
11. BRICKS: Bricks must be tested and approved by the Customer before loading. Once approved, no returns or refunds can be claimed by the customer.
12. EQUIPMENT RENTAL: An operator fee of N$100.00 per hour will be charged when operation is halted due to bad weather conditions/rain.
